The article’s main point is that New Orleans can be rebuilt if the government is temporarily given the right to private property. This is applicable through the use of an arcane legal principle where badly damaged homes can be placed into government hands. By so doing, they want to execute the centuries-old legal concept referred to as Usufruct, which gives individuals the right to develop and profit from other people’s property. However, Robert Nozick argues that in certain circumstances, if one’ labor is mixed with something else, he loses ownership over the property. This is particularly so in cases where the amount of property that is not owned is limited and if the owners of such property are likely to be made worse off if private developers acquire it.

In my opinion, I agree with the article because numerous individuals, through what is not their fault, are now unable to fix up their property. The properties in question are not few in number but number to over 100,000. Apart from that, they are completely damaged to the point that they cannot be inhabited. If the owners are completely incapacitated to rebuild their homes, then it would be prudent that they strike a deal with the government. The government’s challenge in rebuilding New Orleans is acquiring land. As much as this concept is not easy given the constitutional laws governing private property, it is the only viable means by which New Orleans could be repopulated upon recovering its housing stock. This will also ensure that civil servants who make the City of New Orleans work can find safe housing.
